The other flavor supplier settled with all plaintiffs and the Company has settled with 12 plaintiffs by confidential agreement. Plaintiff voluntarily dismissed his claim against Bush Boake Allen, Inc. This case was settled by confidential agreement in October 2006 (Remmes case). Another case concerning 1 other worker at this same plant was filed in January 2006 and is pending in this same court against the same parties.
